NOAA Fisheries requests your comments on the proposed rule for the Timing of Accountability Measure-Based Closures Amendment, which amends the U.S. Caribbean Reef Fish, Spiny Lobster, and Corals and Reef Associated Plants and Invertebrates Fishery Management Plans.  This proposed rule to implement the Timing of Accountability Measure-Based Closures Amendment would modify the date for the implementation of accountability measure-based closures for all species and species groups managed by the Caribbean Fishery Management Council in federal waters off St. Thomas/St. John, St. Croix, and Puerto Rico, except for queen conch.

The purpose of the amendment and this proposed rule is to minimize, to the extent practicable, the adverse socio-economic impacts of accountability measure-based closures, while constraining catch levels to the applicable annual catch limits and preventing overfishing.

Comments are due by March 13, 2017

Summary of Proposed Changes:

  • If the annual catch limit is exceeded, resulting in an accountability measure application, the proposed rule would shift the end date for implementing accountability measure-based fishery closures from December 31st to September 30th, extending backward toward the beginning of the year (January 1).
  • This action responds to a request to avoid, to the extent practicable, closures during the year-end holiday season.
  • This action does not apply to queen conch, for which a separate management approach is applied.
  • The amendment also proposes a maximum time period of two years from implementation of the amendment, and no longer than every two years thereafter, for the Caribbean Fishery Management Council to revisit the approach or the date selected to establish the timing of accountability measure-based closures.

The period for commenting on the proposed rule is open now through March 13, 2017.  You may submit comments on the proposed rule by electronic submission or by postal mail.  All comments received will be addressed in the final rule.  Comments sent by any other method (such as e-mail), to any other address or individual, or received after the end of the comment period, may not be considered by NOAA Fisheries.

El Servicio Nacional de Pesquerías Marinas (NOAA Fisheries, por su nombre en inglés) solicita sus comentarios sobre la reglamentación propuesta que implementaría la “Enmienda para ajustar la temporada de implementación de vedas basadas en medidas de responsabilidad”, la cual enmendaría los Planes de Manejo de las Pesquerías de Peces de Arrecife, Langosta Espinosa y Corales y Plantas e Invertebrados Asociados a los Arrecifes de Coral del Caribe Estadounidense.

Esta enmienda propone ajustar la fecha para la implementación de vedas a la pesca basadas en medidas de responsabilidad para todas las especies y grupos de especies administrados por el Consejo de Administración Pesquera del Caribe en aguas federales de San Tomás/San John, Santa Cruz y Puerto Rico, con excepción del carrucho.

El propósito de la enmienda y de la reglamentación propuesta es, en lo posible, minimizar el impacto socioeconómico de las vedas a la pesca basadas en medidas de responsabilidad, limitando los niveles de captura al límite anual de captura aplicable y evitando la sobrepesca.

El período de comentarios termina el 13 de marzo de 2017.

RESUMEN DE LOS CAMBIOS PROPUESTOS:

  • Si se excede el límite anual de captura y se requiere aplicar una medida de responsabilidad, la reglamentación propuesta propone que en lugar de la fecha de finalización actual del 31 de diciembre, la veda a la pesca comenzaría el 30 de septiembre del año de cierre y se extendería retroactiva hacia el comienzo del año.
  • Esta acción responde a una solicitud para evitar, en la medida posible, vedas basadas en medidas de responsabilidad durante la temporada festiva de fin de año.
  • Esta acción no aplica al carrucho, al cual se le aplica un enfoque de manejo separado.
  • La enmienda también propone un máximo de 2 años a partir de la implementación de la enmienda y cada 2 años subsiguientes para que el Consejo de Administración Pesquera del Caribe revise el procedimiento seleccionado o la fecha establecida para las medidas de responsabilidad.
